What is investment green card or investor visa (EB-5)?

This is a visa category designed for those who invest one million dollars in a new enterprise that employs 10 U.S. workers (exclusive of the immigrant, his/her spouse and sons and daughters) or $500,000 if the investment is in certain rural areas or an area of unemployment of at least 150% of the national average. This preference is allotted 10,000 visas per year. Of these 10,000 visas, 5,000 are set-aside for those who apply under a pilot program involving a CIS-designated "Regional Center."

What are the requirements for investment?
Establishing a new commercial enterprise,
Investing the requisite capital amount,
Proving the investment comes from a lawful source of funds,

Creating the requisite number of jobs,

Demonstrating that the investor is actively participating in the business; and, where applicable,
Creating employment within a targeted employment area.

How long does CIS take to process my visa petition?
 

Processing times vary from as little as a few weeks to as much as six months. We can't predict or promise a particular processing time. You should plan for the entire process to take approximately one year. "EB5 investors" obtain permanent resident status on a conditional basis for two years and then must apply to "remove the condition."

What documents must I prepare to process my visa petition?
    Complete biographical information for each applicant and the principal applicant must prove the source of the investment funds. Due to the complexity of the application, please consult with your attorney before providing any documents.

How do I apply?
    You will be asked to provide the preliminary documents. We will provide you with information about the CIS designated Regional Center Investor Pilot Program. We can assist you in considering the requirements and legal issues based on your background and goals. If you are satisfied with the nature of investments and legal requirements, we can prepare and submit your application to the USCIS.
