Who qualifies under O-1 status?
Aliens of "extraordinary ability" in the sciences, arts, education, or athletics.

What constitutes "extraordinary ability"?
A person who has risen to the very top of his or her field of endeavor.

What needs to be shown to demonstrate extraordinary ability?
Person must demonstrate sustained national or international acclaim and recognition for achievements in the field of expertise.

What is the duration of stay?
Initial period of stay is up to three years and extensions of stay can be granted in increments of up to one year. There is no explicit statutory limitation on the period of stay.

What steps must an employer take in order to obtain O status for an employee?
Gather all supporting documents from the beneficiary; obtain advisory opinion from peer group, labor organization, or management organization; approval by CIS of an O petition supported by the advisory opinion; and issuance by a U.S. consulate of an O visa based on the approved petition.
